Landlords & Realtors File Lawsuit Against Prop M: 3 sections suspended, but most of measure in effect

Next Court Date: April 27, 2009

Landlord and Realtor organizations have filed a lawsuit against Prop M, asserting they have the right to harass tenants.

While these real estate organizations asked the courts to suspend Prop M in its entirety, Judge Paul Alvarado agreed only to suspend 3 of the 15 sections defining harassment (2 dealing with tenant buyouts and 1 prohibiting threatening "the tenant with physical harm," which Alvarado apparently thinks it's okay for landlords to do).

At least until the case returns to court on April 27, the Rent Board will accept petitions for rent reductions under Prop M but will not hold any hearings or make decisions on them until after the April court hearing.
